1. Agreement to Terms

By accessing or using the FlowForce AI search optimization platform ("the Service"), operated by FlowForce ("we," "us," or "our"), you agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and FlowForce, governed by the laws of the Kingdom of Thailand.

2. Description of Service

FlowForce is an AI search optimization platform designed for businesses seeking to improve their visibility in AI-powered search results. The Service includes, but is not limited to:

• AI visibility scans: Automated scans that analyze how your website appears in AI-powered search responses across major platforms.
• Website audits: Comprehensive analysis of your website's structure, content, and technical signals for AI search optimization.
• Optimization recommendations: AI-generated action plans and recommendations to improve your visibility in AI search results.
• Competitor tracking: Monitor competitor websites' AI search visibility and compare performance against your own.
• Visibility scores: Metrics measuring your presence across AI search platforms and categories.
• Category and query analysis: Understand which search categories and queries your site ranks for in AI search.
• Email digests: Email summaries of audit results and visibility updates delivered to your inbox.
• Recommendation management: Track recommendation status, provide feedback, and add notes on optimization actions.
• Export: Export audit data and recommendations for use in external tools (available on Pro and Business plans).

3. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement under the laws of your jurisdiction. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You may register using an email address and password, a magic link sent to your email, or through Google OAuth.

You are responsible for:

• Maintaining the confidentiality and security of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately at support@flowforce.agency if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that contain inaccurate information or are used in violation of these Terms.

5. Subscription Plans and Payment

FlowForce offers the following subscription plans:

• Free: USD $0 per month — Limited AI visibility scans and basic website audits.
• Pro: USD $99 per month — Full AI visibility scans, website audits, optimization recommendations, competitor tracking, and export.
• Business: USD $199 per month — All Pro features, advanced competitor tracking, content strategy, competitor alerts, and priority support.

By subscribing, you agree to the following payment terms:

• All payments are processed securely through Stripe. FlowForce does not store your credit card information.
• Monthly subscriptions are billed automatically on each billing cycle.
• You may cancel your subscription at any time through your account settings or the Stripe Customer Portal.
• Cancellations take effect at the end of the current billing period. You will retain access to the Service until that date.
• No refunds are provided for partial billing periods.
• Free trials are no longer offered for new signups. Existing trial subscriptions will continue until their scheduled end date.
• We reserve the right to modify pricing at any time with at least 30 days' prior notice. Continued use after the price change takes effect constitutes acceptance.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws, including but not limited to Thailand's Computer Crime Act B.E. 2550 (2007), anti-spam legislation (CAN-SPAM, GDPR), and the Thai Personal Data Protection Act B.E. 2562 (PDPA).
• Scrape, copy, redistribute, or resell audit data or visibility data obtained through the Service.
• Attempt to gain unauthorized access to the Service, its infrastructure, or other users' accounts.
• Use automated tools, bots, or scripts to access the Service beyond the features and APIs we provide.
• Share your account credentials with unauthorized third parties.
• Use the Service to send unsolicited communications in violation of applicable anti-spam laws in the recipient's jurisdiction.
• Interfere with or disrupt the integrity or performance of the Service.

7. Audit Data Disclaimer

Audit data, visibility scores, and optimization recommendations provided by FlowForce are generated through our analysis engine and AI search APIs. We do not guarantee the accuracy, completeness, timeliness, or reliability of any audit data or visibility metrics.

You are solely responsible for independently verifying any recommendations before implementing them. Visibility scores and AI search rankings are algorithmic assessments and do not guarantee improved search outcomes or business results.

8. AI-Generated Content

The Service uses artificial intelligence (powered by OpenAI) to generate optimization recommendations based on your website audit data. These AI-generated recommendations are provided "as is" for informational purposes only. You acknowledge that:

• AI-generated content may contain inaccuracies or may not be suitable for your specific needs.
• You are solely responsible for reviewing, editing, and approving any AI-generated recommendations before implementing them.
• FlowForce is not liable for any consequences arising from your use of AI-generated optimization recommendations.

9. Intellectual Property

The Service, including its design, source code, features, algorithms, user interface, and all associated content, is owned by FlowForce and protected by applicable intellectual property laws, including those of the Kingdom of Thailand and international treaties.

During the term of your subscription, you are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. This license does not grant you any ownership rights in the Service.

10. Limitation of Liability

To the maximum extent permitted by the laws of the Kingdom of Thailand, including the Thai Civil and Commercial Code:

• FlowForce shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, arising from or related to your use of or inability to use the Service.
• Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount you paid to FlowForce in subscription fees during the twelve (12) months immediately preceding the event giving rise to the claim.
• FlowForce shall not be liable for any actions you take based on audit data or AI-generated recommendations provided through the Service.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components. We do not warrant that audit data or visibility scores will lead to any particular business outcome.

12. Termination

We may suspend or terminate your account at our sole discretion if you violate these Terms, engage in conduct that is harmful to the Service or other users, or for any other reason we deem necessary to protect the integrity of the Service.

Upon termination, your right to use the Service ceases immediately. Your account data will be retained for 90 days following termination or cancellation to allow for potential re-activation, after which it will be permanently deleted.

Sections 7, 8, 9, 10, 11, 13, and this section shall survive termination of these Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, including but not limited to:

• The Thai Civil and Commercial Code.
• The Computer Crime Act B.E. 2550 (2007) and its amendments.
• The Electronic Transactions Act B.E. 2544 (2001).
• The Personal Data Protection Act B.E. 2562 (2019).

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Thailand.

Before initiating any formal legal proceedings, the parties agree to attempt to resolve disputes amicably through good-faith negotiation for a period of at least 30 days following written notice of the dispute.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance by email or through a prominent notice within the Service. The "Last updated" date at the top of this page indicates when the Terms were last revised.

Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and FlowForce regarding the use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
