Terms of Service

1. Agreement to Terms

By accessing or using the FlowForce B2B SaaS lead generation platform ("the Service"), operated by FlowForce ("we," "us," or "our"), you agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and FlowForce, governed by the laws of the Kingdom of Thailand.

2. Description of Service

FlowForce is a B2B SaaS lead generation platform designed for SaaS founders, startups, and sales teams. The Service includes, but is not limited to:

• Daily ICP-matched lead delivery: Curated lists of B2B companies matching your Ideal Customer Profile, delivered to your dashboard each morning with verified decision-maker contacts and fit signals.
• Ideal Customer Profile (ICP) configuration: Define your target customers by describing your SaaS product in plain language. Our AI interprets this into structured criteria including target industries, company sizes, technology stacks, competitor tools to displace, funding stages, and decision-maker titles.
• Fit signal matching: Each lead includes specific reasons why they match your ICP, such as competitor tool usage, technology stack alignment, growth stage, and company size — giving you context for personalized outreach.
• AI-generated outreach angles: Personalized pitch suggestions generated by artificial intelligence for each lead, referencing their specific fit signals and how your product addresses their needs.
• Built-in email outreach: Connect your email account (Gmail, Outlook, or SMTP) to send personalized outreach emails directly from FlowForce with tracking for opens, clicks, and replies.
• Email sequences: Create automated multi-step follow-up sequences to increase reply rates (available on Growth and Scale plans).
• Domain exclusions: Block specific domains (e.g., existing clients, competitors) from appearing in your leads.
• Daily email digests: Email summaries of new leads delivered to your inbox each morning.
• Lead management: Track lead status (new, viewed, saved, dismissed, contacted), provide feedback, and add notes.
• Team collaboration: Organization-level accounts with multiple team seats and invite management (available on Growth and Scale plans).
• CSV export: Export lead data for use in external CRMs and outreach tools (available on Growth and Scale plans).

3. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement under the laws of your jurisdiction. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You may register using an email address and password, a magic link sent to your email, or through Google OAuth.

You are responsible for:

• Maintaining the confidentiality and security of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately at support@flowforce.agency if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that contain inaccurate information or are used in violation of these Terms.

5. Subscription Plans and Payment

FlowForce offers the following subscription plans:

• Trial: Free 5-day trial — 10 leads per day, 1 ICP, 1 team seat, 20 emails per month. Automatically continues as Starter ($79/mo) unless cancelled.
• Starter: USD $79 per month — 10 leads per day, 1 ICP, 1 team seat, 20 emails per month.
• Growth: USD $149 per month — 20 leads per day, up to 5 ICPs, up to 3 team seats, 200 emails per month, 3-step email sequences, CSV export.
• Scale: USD $299 per month — 50 leads per day, up to 10 ICPs, up to 10 team seats, unlimited emails, 5-step email sequences, CSV export.

By subscribing, you agree to the following payment terms:

• All payments are processed securely through Stripe. FlowForce does not store your credit card information.
• Monthly subscriptions are billed automatically on each billing cycle.
• You may cancel your subscription at any time through your account settings or the Stripe Customer Portal.
• Cancellations take effect at the end of the current billing period. You will retain access to the Service until that date.
• No refunds are provided for partial billing periods.
• The Trial plan is limited to one trial per email address and one trial per payment card.
• We reserve the right to modify pricing at any time with at least 30 days' prior notice. Continued use after the price change takes effect constitutes acceptance.

6. Team Accounts

Growth and Scale plans include multiple team seats within an organization. The account owner (organization administrator) is responsible for:

• All team members' use of the Service and compliance with these Terms.
• Managing team invitations, which expire after 7 days.
• Ensuring the number of team members does not exceed the plan's seat limit.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws, including but not limited to Thailand's Computer Crime Act B.E. 2550 (2007), anti-spam legislation (CAN-SPAM, GDPR), and the Thai Personal Data Protection Act B.E. 2562 (PDPA).
• Scrape, copy, redistribute, or resell lead data obtained through the Service.
• Attempt to gain unauthorized access to the Service, its infrastructure, or other users' accounts.
• Use automated tools, bots, or scripts to access the Service beyond the features and APIs we provide.
• Share your account credentials with unauthorized third parties.
• Use the Service to send unsolicited communications in violation of applicable anti-spam laws in the recipient's jurisdiction.
• Interfere with or disrupt the integrity or performance of the Service.

8. Lead Data Disclaimer

Lead data provided by FlowForce is sourced from Apollo.io and other B2B data providers, as well as publicly available business information. This includes company details, technology stack data, funding information, and decision-maker contact information. We do not guarantee the accuracy, completeness, timeliness, or reliability of any lead data.

You are solely responsible for independently verifying any lead information before acting on it, including contact details, business status, and company information. Fit signals and ICP matching are algorithmic assessments and do not guarantee business outcomes.

8A. Email Outreach Compliance

When using FlowForce's built-in email outreach features, you agree to:

• Comply with all applicable anti-spam laws in your jurisdiction and the recipient's jurisdiction, including CAN-SPAM (United States), GDPR (European Union), CASL (Canada), and similar regulations.
• Only send emails to business contacts for legitimate B2B prospecting purposes related to your SaaS product or service.
• Include accurate sender information and a clear way to opt out of future communications.
• Honor opt-out requests promptly (within 10 business days as required by CAN-SPAM).
• Not use the Service to send spam, malware, phishing attempts, or any content that violates applicable laws.

FlowForce reserves the right to suspend or terminate your access to email features if we detect abuse, excessive bounce rates, spam complaints, or violations of this section.

9. AI-Generated Content

The Service uses artificial intelligence (powered by OpenAI) to generate outreach angle suggestions for each lead. These AI-generated suggestions are provided "as is" for informational purposes only. You acknowledge that:

• AI-generated content may contain inaccuracies or may not be suitable for your specific needs.
• You are solely responsible for reviewing, editing, and approving any AI-generated content before using it in communications.
• FlowForce is not liable for any consequences arising from your use of AI-generated outreach suggestions.

10. Intellectual Property

The Service, including its design, source code, features, algorithms, user interface, and all associated content, is owned by FlowForce and protected by applicable intellectual property laws, including those of the Kingdom of Thailand and international treaties.

During the term of your subscription, you are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. This license does not grant you any ownership rights in the Service.

11. Limitation of Liability

To the maximum extent permitted by the laws of the Kingdom of Thailand, including the Thai Civil and Commercial Code:

• FlowForce shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, arising from or related to your use of or inability to use the Service.
• Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount you paid to FlowForce in subscription fees during the twelve (12) months immediately preceding the event giving rise to the claim.
• FlowForce shall not be liable for any actions you take based on lead data or AI-generated content provided through the Service.

12. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components. We do not warrant that lead data will lead to any particular business outcome.

13. Termination

We may suspend or terminate your account at our sole discretion if you violate these Terms, engage in conduct that is harmful to the Service or other users, or for any other reason we deem necessary to protect the integrity of the Service.

Upon termination, your right to use the Service ceases immediately. Your account data will be retained for 90 days following termination or cancellation to allow for potential re-activation, after which it will be permanently deleted.

Sections 8, 9, 10, 11, 12, 14, and this section shall survive termination of these Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, including but not limited to:

• The Thai Civil and Commercial Code.
• The Computer Crime Act B.E. 2550 (2007) and its amendments.
• The Electronic Transactions Act B.E. 2544 (2001).
• The Personal Data Protection Act B.E. 2562 (2019).

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Thailand.

Before initiating any formal legal proceedings, the parties agree to attempt to resolve disputes amicably through good-faith negotiation for a period of at least 30 days following written notice of the dispute.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance by email or through a prominent notice within the Service. The "Last updated" date at the top of this page indicates when the Terms were last revised.

Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and FlowForce regarding the use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
